When do these warranty terms and conditions apply?
Albert Kerbl GmbH does not provide a general warranty for all Kerbl products. The following warranty terms apply exclusively to Kerbl products for which these warranty terms are expressly referred to. A corresponding notice is provided
- in the user manual or
- in the documentation supplied with the product or
- on the product or its packaging, or
- in our advertising for the relevant product
Relationship to the statutory warranty
The guarantee is a voluntary service provided by Albert Kerbl GmbH. Your statutory warranty rights against the seller (retailer) remain unaffected by this.
Warranty Terms
- The product is guaranteed to be free from material defects for the duration of the period specified in clause 3.
The guarantee entitles the end customer to a refund of the purchase price, replacement of the purchased item or repair of the purchased item – at Kerbl’s discretion – provided that a defect becomes apparent during the guarantee period
- and the defect is not attributable to the end customer and/or
- the defect is not attributable to damage occurring during transport to the end customer and/or
- the defect is not attributable to damage caused by force majeure.
Any claims beyond this, in particular claims for reimbursement of costs incurred in carrying out repairs oneself or claims for compensation for consequential damage resulting from the defect, are not covered by the warranty.
- If a warranty is granted for a product with reference to these warranty terms and conditions, its duration shall be governed by the warranty period specified for the product in question. If reference is made to these warranty terms and conditions but no warranty period is specified, the warranty period shall be two years. The warranty period commences upon the transfer of risk of the brand-new product to the end customer.
- In addition to the provisions on the warranty period set out in clause 3, different warranty terms may apply to individual products. Where different warranty terms are specified for a particular product, these shall, as a general rule, take precedence over these warranty terms.
- A warranty claim does not result in any extension of the warranty period and/or expansion of the scope of the warranty. This also applies to material defects reported in good time within the warranty period or rectified within the warranty period.
- The warranty is valid worldwide, but exclusively in accordance with the law of the Federal Republic of Germany.
- The warranty rights apply only to the first end customer of the brand-new product and are non-transferable.
- To ensure that the rights under this warranty are exercised in good time, it is both sufficient and necessary to submit the relevant warranty claim clearly (including as precise a description as possible of the fault and, where applicable, the external circumstances in which the fault occurs) and in writing (letter, fax) or in text form (email) to Albert Kerbl GmbH (see above for address and further contact details), whereby the timely receipt of the claim letter or email by Albert Kerbl GmbH is decisive. - The following are excluded from the warranty
- Damage resulting from or partly attributable to improper use, storage, installation or set-up,
- Damage caused by or resulting in part from improper maintenance and/or failure to replace wear parts in good time,
- Damage caused by or partly attributable to third-party software, connected third-party devices or stored data,
- Damage caused by or partly attributable to external influences, such as damage caused by third parties, adverse weather conditions such as heavy rain, frost, lightning strikes, excessive sunlight and the like,
- Wear-and-tear parts, such as light bulbs, rubber suction cups, seals, drive belts, valves and water-carrying components, cutting blades, brushes, batteries, rechargeable batteries and the like,
- custom-made items,
- consumables, such as fuels, oils, filters, etc.
- Furthermore, the warranty shall lapse in the following cases
- the use of non-genuine accessories or non-genuine spare parts from Kerbl,
- if the item or any of its components are opened incorrectly,
- repairs or modifications not carried out by Kerbl itself or a service partner authorised by Kerbl,
- if the item continues to be used despite the failure to carry out repairs that are clearly necessary,
- in the event of failure to comply with operating, maintenance, storage and transport instructions, as well as in the event of improper operation, maintenance, use, cleaning, care or handling, or in the event of problems attributable to the connection of third-party devices other than those described in the operating instructions,
- failure to replace wear parts in good time.
- Albert Kerbl GmbH is entitled, in accordance with Section 315 of the German Civil Code (BGB), to decide at its own reasonable discretion whether a defect covered by the warranty is to be remedied or compensated for by repair, replacement of the product, a full or partial refund of the purchase price, or by any other suitable means.
- In the event of valid warranty claims, Albert Kerbl GmbH shall bear the costs of rectifying the material defect as well as the transport costs from the end customer to Albert Kerbl GmbH or a third party commissioned by Albert Kerbl GmbH, and back to the end customer. Any costs incurred by Albert Kerbl GmbH as a result of the manifestly unjustified assertion of warranty claims, such as transport costs, insurance costs, packaging costs and the like, shall be reimbursed to Albert Kerbl GmbH by the claimant, together with a flat-rate processing fee of €50.00 per case.
- The risk of loss or accidental damage to the product during transport from the end customer to Albert Kerbl GmbH or to a third party commissioned by Albert Kerbl GmbH shall be borne by the sender/end customer. The risk of loss or accidental destruction of the product during transport from Albert Kerbl GmbH or the third party commissioned by Albert Kerbl GmbH to the end customer shall be borne by Albert Kerbl GmbH.
- This guarantee does not restrict the purchaser’s statutory warranty rights – which exist alongside it and remain in force – in accordance with Sections 437 et seq. of the German Civil Code (BGB) or, where foreign law applies, in accordance with the relevant warranty provisions of the respective country.
